TERMS & CONDITIONS

Welcome to Cinnamon Basics. These Terms & Conditions ("Terms") govern your use of the Cinnamon Basics website (https://cinnamonbasics.com) and the Cinnamon Basics mobile application (together, the "Service"), both operated by NH Garments Limited ("we", "our", or "us").

By creating an account, browsing, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and place orders. By using the Service you confirm that the information you provide is accurate and that you are legally able to enter into a binding contract with us.

2. Your account

  • You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • Notify us immediately at marketing@nhgarments.com if you suspect unauthorised access.
  • We may suspend or terminate accounts that violate these Terms, are used fraudulently, or remain inactive for an extended period.
  • You may delete your account at any time from the Profile screen, subject to the data retention rules in our Privacy Policy.

3. Products and pricing

  • All prices are listed in Ghana Cedis (GHS) and are inclusive of applicable taxes unless stated otherwise.
  • Delivery charges, where applicable, are calculated at checkout and shown before you confirm payment.
  • We make every effort to display product colours, fabrics, and sizing accurately, but minor variations between the on-screen image and the delivered item may occur due to lighting and screen settings.
  • Prices and product availability may change at any time without notice. Promotional offers are valid only for the period stated and cannot be combined unless we say so.
  • If a product is mispriced due to a clerical or technical error, we reserve the right to cancel the order and refund any payment received.

4. Orders and acceptance

Placing an order is an offer to buy. A binding contract is only formed once we confirm the order has been accepted and dispatched. We may decline or cancel orders for reasons including, but not limited to:

  • Stock unavailability.
  • A pricing or product description error.
  • Suspected fraud or breach of these Terms.
  • Inability to deliver to the address provided.

If we cancel an order after payment, you will receive a full refund to the original payment method.

5. Payment

Payments are processed securely by Paystack. We accept Visa, Mastercard, and supported mobile-money options. By submitting payment details you confirm that you are authorised to use the chosen payment method.

Card and mobile-money details are handled directly by Paystack and never pass through our servers. See our Privacy Policy for further detail.

6. Delivery

  • Estimated delivery times are provided as a guide and are not guaranteed. Delays may occur due to courier, customs, or weather conditions outside our control.
  • You are responsible for providing an accurate delivery address and a contact number on which the courier can reach you.
  • Risk of loss passes to you when the order is handed over to the courier or collected. Title passes to you once payment has been received in full.
  • If a delivery is unsuccessful and the parcel is returned to us, we may charge a re-delivery fee.

7. Returns and refunds

  • You may request a return within 7 days of delivery if the item is unworn, unwashed, undamaged, and in its original packaging with all tags attached.
  • Items marked as final sale, intimate apparel, and customised items are not eligible for return unless they arrive faulty.
  • If an item is faulty, incorrect, or damaged on arrival, contact us within 48 hours of delivery so we can arrange a replacement or refund.
  • Approved refunds are issued to the original payment method within 14 business days of the returned item being received and inspected.
  • Original delivery charges are non-refundable except where the return is due to our error.

8. Acceptable use

When using the Service you agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Attempt to gain unauthorised access to our systems, accounts, or data.
  • Interfere with the Service through reverse engineering, scraping, automated tools, or denial-of-service techniques.
  • Impersonate another person or misrepresent your affiliation with anyone.
  • Resell goods purchased from us through unauthorised channels for commercial gain.

9. Intellectual property

All content on the Service — including the Cinnamon Basics name and logo, product designs, photography, illustrations, copy, and software — is owned by or licensed to NH Garments Limited and is protected by intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our prior written consent, except for personal, non-commercial browsing.

10. User content

If you submit reviews, photos, or other content through the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and reproduce that content in connection with operating and promoting the Service. You are responsible for ensuring the content is yours to share and does not infringe anyone else's rights or violate any law.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. While we work hard to keep it running smoothly, we do not warrant that the Service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

12. Limitation of liability

To the maximum extent permitted by law, NH Garments Limited shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits any liability that cannot be excluded under applicable consumer protection law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have breached these Terms or applicable law. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. The "Effective date" at the top will reflect the most recent change. For material changes we will notify you in the App or by email before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Ghana. Any dispute arising out of or in connection with the Service shall be submitted to the exclusive jurisdiction of the courts of Ghana, without prejudice to any mandatory consumer rights you may have in your country of residence.
